Terms of Service

tapioca is a project management and financial planning platform provided by BCP Technology ("we", "us", "our"). These Terms govern your use of:

• The tapioca hosted SaaS platform at app.tapioca.dev
• The tapioca open-source software for self-hosting
• Related APIs, documentation, and support services

By using tapioca, you agree to these Terms. If you are using tapioca on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account Creation

To use tapioca's hosted service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials.

Account Types

• Individual accounts: For personal use
• Organization accounts: For teams and companies
• Enterprise accounts: With custom SLA and support

Account Responsibilities

• You must be at least 16 years old to create an account
• You must provide accurate and complete information
• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized access

You agree to use tapioca in compliance with all applicable laws and regulations. You must not:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Upload malicious code, viruses, or harmful content
• Violate the intellectual property rights of others
• Harass, abuse, or harm other users
• Use the service to send spam or unsolicited messages
• Attempt to reverse engineer the service (except as permitted by the open-source license)
• Resell access to the hosted service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

Your Content

You retain all rights to the content you create in tapioca (projects, tasks, documents, etc.). You grant us a limited license to store, display, and process your content solely to provide the service.

Open Source License

The tapioca software is open source under the GNU Affero General Public License v3.0 (AGPL-3.0). You may self-host, modify, and distribute the software in accordance with that license.

Our Intellectual Property

The tapioca name, logo, and branding are trademarks of BCP Technology. The hosted service infrastructure, proprietary features, and documentation are our intellectual property.

Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

Pricing Tiers

• Self-Hosted: Free for up to 5 users (commercial). Unlimited for education/NGO/OSS.
• Starter: Hosted SaaS, free for 1 user
• Team: Hosted SaaS, €20/month for 2-5 users
• Growth: Hosted SaaS, €5/user/month for 6+ users

Volume Discounts

• Contact us for volume pricing on 100+ users

Payment Terms

• Payments are processed via Stripe
• Billing is monthly or annual (with discount)
• Prices are in Euros (€) and exclude applicable taxes
• We may change prices with 30 days notice

Refunds

We offer a 14-day money-back guarantee for new paid subscriptions. Contact support for refund requests.

Uptime

We strive for high availability but do not guarantee 100% uptime for non-Enterprise plans. Enterprise customers have specific SLA commitments.

Maintenance

We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice when necessary for security or stability.

Service Modifications

We may modify, suspend, or discontinue features with reasonable notice. We will not remove core functionality without a migration path.

Important – Please read carefully

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
• FOR FREE PLANS, OUR LIABILITY IS LIMITED TO €100

These limitations apply to all claims, whether based on warranty, contract, tort, or any other legal theory.

Termination by You

You may cancel your account at any time from your account settings. Upon cancellation:

• Your subscription will not renew
• You may export your data before the account closes
• Data will be deleted within 30 days

Termination by Us

We may terminate or suspend your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Fail to pay fees when due
• Abuse the service or other users

For non-urgent violations, we will provide notice and an opportunity to cure before termination.

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at [email protected].

Jurisdiction

Any legal proceedings shall be brought exclusively in the courts of Berlin, Germany. You consent to personal jurisdiction in these courts.

Class Action Waiver

To the extent permitted by law, disputes must be brought individually, not as part of a class action.

We may update these Terms from time to time. When we make significant changes:

• We will notify you via email or in-app notification
• We will post the updated Terms on this page
• We will update the "Last updated" date
• Changes take effect 30 days after notification

Your continued use of tapioca after changes take effect constitutes acceptance of the new Terms.
